5. Last Will and Testament of Moses Smith, Deceased

In the name of God Amen. I Moses Smith of Abbeville District and the State of South Carolina finding myself being frail through the infirmity of old age and not knowing how soon I may be called away from time and being of sound mind and memory and wishing to dispose of my wordly property do make this my last will and testament disarming all former Wills and in form following viz(???)

Item 1st. I give and bequeath to my son George Smith one negro girl named Ellise also two hundred dollars and fifty.

I give and bequeath to my son William Smith one tract of land two hundred acres or thereabouts lying on the barren branch (???) on which he now lives. I also give to my son Robert Smith three hundred and thirty acres of land lying on Turkey Creek (???) on which he now lives which will make them equal with Joseph Ebenezer and Samuel Smith all of whom I calculate to have received(???) the value of (lielve???) hundred dollars.

Item 2nd. I give and bequeath to my daughter Janie Cullins all my interest in a tract of land that she now lives on in the State of Indiana for which I have paid something more than six hundred dollars which I conceive will (in whie???) her equal to the above Legatees.

Item 3rd. I give to my grandchildren Jas Dun and Moses Dun, children of my daughter Feby(??) Dun as follows. I give and bequeath to Jas Dun one hundred and fifty dollars which will make him equal to five hundred dollars with what he has (rec ??), also I give to Moses Dun one hundred dollars with what I have already give them two will make them have received eight hundred dollars

Item 4th. I give and bequeath to my son Benjamin all the plantation of land on which I now live containing five hundred and twenty three acres together with all the improvements also five negroes one named (Jaehn??) Tilman (Iirhy??) and child Aggy,Lbby(?) and Enoch also all my household and kitchen furniture.

Item 5th. All the remainder of my property that I may die possessing(??) of, it is my will that it shall be sold and the proceeds of the same with what notes and money I may have at my death take equally divided between my children William, Joseph, George, Robert, Benjamin, Samuel, Ebenezer, and Jane Cullens, and the heirs of my daughter (Fiby Juby ??) Dun, Jas and Moses Dun to receive their mothers part of my estate that is to be sold after my death.

Item 6th. It is my will and desire that Wm Barmore and Samuel Agnew Senn(??), be the Executors of this my last will and testament. In witness whereof I have hereunto let my hand and seal this tenth(??) of February one thousand and eigth hundred and thirty seven and sixty second of American Independence.

Signed Sealed and declared to be my last will and testament in (fraener??) of us W. Enoch Barmore, Michard P. Bowie, Washington Drummon
